However, the ICC has not intervened or applied its authority over the 1948 territories (i.e., Israel), regardless of the citizenship of the perpetrator of the crime, particularly because the local justice system is incapable or unwilling to prosecute Israelis, which leads to an escape from justice if they are not prosecuted by the ICC.”
